Carol was right about Wolf!

She told me that a Judge Wolf, in Massachusetts, was the only honest judge she was aware of. While cleaning out my emails today I discovered a story about him. Here it is!


Soon after I met Carol Murhpy, I discovered that five of the seven judges she sued had taken part in dirty decisions against us! However, in the fall of 2006, all of the judges were dismissed from her case. Why? Here's a link to the decision; and quoting from it: 

Because the doctrine of judicial immunity bars her claims against the judicial defendants, the Court grants their motion to dismiss Carol Murphy’s Amended Complaint. 

Carol has been incarcerated in Somerset County jail in Maine since mid October. Check my post of last fall to read about the conditions surrounding her arrest. It cost about $60,000 to house a prisoner in Maine, or about $200 a day. Does Carol Murphy pose such a threat to the public as to justify this? It's probably costing taxpayers more than that for her bed at Riverside - the psych ward in Augusta Maine where Carol's been sent for an evaluation, though she had told me she did not consent to one. 

Carol says the state is trying to push an attorney on her, so they can screw her! She mentioned Corpus Juris Secundum. In a letter dated April 25, 1998,  found at http://www.chicagoabc.org/abolish_document.htm, was this: 

Attorneys take an oath to uphold the judicial system over the rights of a client. This is in their Corpus Juris Secundum, Attorney & Client, Volume 7, Section 4.

I've posted the comment, though I don't know what it says.

Judgepedia reliable, Wikipedia ?????

At Wikipedia, there's an entry for Ronald M. George, but there's nothing in it regarding SBX 2 11 or stories which reflect negatively on him. George is the chief justice of California Supreme Court: http://en.wikipedia.org/wiki/Ronald_M._George.


A while back, I posted to Wikipedia about Ronald George (then listed without the middle initial M). Now if you go to the link, it directs you to the new Ronald M. George post. Here's the old link http://en.wikipedia.org/wiki/Ronald_George. I wonder if the middle initial was added by someone at Wiki so the old entry under Ronald George, could be made obsolete.  

Under the old entry, my posts had been constantly moved into history. I don't like the new unimproved version. I checked my emails and found a link to the post I made at Judgepedia, which includes the information I posted about SBX 2 11, as well as cases Justice George was involved in, which others wrote about, and which Wikipedia apparently doesn't want the public to know about:

Aroostook Watchmen interviews James Traficant!

The former congressman was released from prison in September after serving seven years. What was the crime? He's anti-government, or anti-corrupt government, as Steve puts it.

James has refused interview offers from mainstream media; but spoke with Steve Martin and Jack McCarthy (Continental Congress candidate) on their humble little Aroostook Watchmen radio show (AM 780 WXME) in Monticello, Maine, this morning! Here's a video/interview with Traficant, by Chris Mathews of "Hardball." And here's a link to the Aroostook Watchmen show, where Steve and Jack's interview with Traficant should be available soon. 

Steve's had some impressive guests on his show lately, including Congressman John Shadegg recently. Shadegg's been trying for years to pass "The Enumerated Powers Act." I've written about that in my book! If passed, Congress would have to point to the constitutional authority behind passing each and every law! Bill Beardsley (gubernatorial candidate, former president of Husson College) was interviewed earlier this week... and the guys have set up a gubernatorial debate for February 17!

Jack and Steve do their show every morning Monday through Saturday. Kellett - Assistant District Attorney for Hancock County, Maine

I received an email with a link to a story written by Carey Roberts. "In Maine, it doesn't pay to be a man."  Several months ago, I posted a link to a story about D.A. Mary Kellett, whose been prosecuting men though it's their partners who are often the abusers. Last year, several men testified about this sort of thing in public hearings at the state house; some woman are abusing "protection from abuse" orders. I listened at www.maine.gov/legis.

Well, Superior Judge Kevin Cuddy recently found Kellett was guilty of prosecutorial misconduct; but it doesn't appear she'll lose her job. The D.A. position held by Michael Povich in Hancock County is up for grabs however. 

Here's another story about something which happened in Hancock County. Kellett is in it; evidently, a 51 year old teacher in Blue Hill pled guilty to sex crimes and was sentenced to 28 years in prison. So what went wrong? We do fingerprinting of teachers and substitute teachers in Maine to avoid letting people like this into the school system. So much for that; the guy had a previous felony sexual offense conviction in New York in 1982, and more...

Now, back to Filler's story, Mr. Filler was awarded custody of his two children: http://www.fillerfund.com/latest.htm. About a year ago, a BDN news story reported the story after a jury convicted him. Filler's defense attorney, Daniel Pileggi, spoke about the alleged assault on Mrs. Filler: "there was no physical or forensic evidence to support the gross sexual assault charge."

U.S. Supreme Court drops case after argument, but before a decision!

The case involved two prisoners who had been found innocent and released from jail and who filed a lawsuit against the prosecutor. So why didn't the Court issue a decision? The parties settled, for $12 million.

Do you think the U.S. Supreme Court would have found the prosecutor was not entitled to immunity? Judges systemically give immunity to prosecutors, judges, and elected officials when lawsuits are filed against them... even when it's obvious those individuals have violated the constitutional rights of others.

Snowe - Maine - full of it!

I got a letter, albeit a generic one, from Senator Olympia Snowe the other day. She believes that Maine's medical malpractice screening panels are a success. Well, they are, for doctors and their liability insurance providers. Valid claims are often defeated before they can ever get to trial, because of the Maine Health Security Act... don't let the name fool you. Even obvious errors, such as the misdiagnosis of my son's broken arm as a shoulder dislocation, in the year 2000. He never got a trial; a judge granted judgment to the defendants, without a trial. It's called summary judgment. The Maine Supreme Court affirmed.  

I found history of the Maine Health Security Act the Maine Supreme Court decision, Brand v. Seider. When you get to paragraph 9, keep in mind that "derogation" means "the partial taking away of."

Medicaid-reimbursed erectile dysfunction surgery, for a convicted rapist!

It was while researching medical malpractice statutes several months ago that I came (excuse the pun) upon the Superior Court case Pease v. Kester, M.D. (2005). A convicted rapist got a penile prosthesis implant (allowing him to get an erection on demand) at some point after his release from prison. Quoting from the Kennebec County Superior Court decision: "Medicaid authorized reimbursement for this procedure..." The man then raped another woman, and when she tried to sue the doctor who performed the surgery, the doc hid behind provisions of the Maine Health Security Act which make it nearly impossible for victims of medical malpractice to ever get to trial. Justice Don Marden dismissed Pease's case soon after he ruled against us in PJM Builders Inc. v. Maine-Wide Construction, in December of 2004. The Maine Supreme Court affirmed Marden's decision in both of these cases. Click below to read the Maine Supreme Court decisions. Both were memorandums; a memorandum of decision is basically a decision with little or no explanation. Memorandums rely on the reasoning in other, reportedly similar, cases.

Judge Marden also ruled in Dennis Dechaine's motion for post-conviction review, denying it in 1999.  

After changes to the law were made which make it easier for Dennis to be exonerated - after all, no evidence of his guilt exists - Dennis' lawyer asked for a new trial. That was over a year ago. I haven't heard that one was scheduled; have you? 

Maine Patriots' conference call to start up this week!

Continental Congress President Michael Badnarik hospitalized!

According to Gary Franchi, National Director of Restore the Republic, Michael has had a heart attack. In an email from Gary, which made its way to me through other patriots:


"His Mother, Elaine, reported to me that Michael was in Madison, Wisconsin attending a hearing regarding a raw milk case. After the hearing he got in a car to go to lunch with friends, He then slumped over. His friends attempted CPR and contacted the paramedics. They attempted to revive him 3 times with no success. Upon the 4th attempt his heart was revived yet with erratic behavior." ~Gary Franchi

Overtime pay being denied many!

I just opened up an email and discovered in it a story about the large number of workers suing over unpaid wages.

In 1999, the U.S. Supreme Court took up a case (Alden v. Maine) involving overtime pay, but really the question was regarding sovereign rights. Could the state of Maine be forced into its own courts? The case involved employees of the state of Maine who had been denied overtime. Judges wouldn't let them get through in state of federal courts in Maine. The decision of the U.S. Supreme Court was narrow, 5-4 against the probabiton officers, one whose name was John Alden. Justice Souter wrote an awesome dissent.

The U.S. Secretary of Labor, it was mentioned in the decision, could have filed a lawsuit on behalf of citizens of Maine, but didn't. Maybe it's time for one now. Actually, I don't believe that overtime pay is a constitutional right; so let this federal "Act" be held unconstitutional. Mandatory overtime pay (which is 1.5 times employee's regular pay rate) is an interference by government into contracts between employers and employees. It's no wonder that the U.S. Supreme Court has never held the mandatory O.T. pay rate unconstitutional though; I mean it allows the government to collect all that much more payroll taxes from us.

Citizen's Forums On Judicial Accountability - CFOJA

Zena Crenshaw is a regular on Dr. Shirley's show; she's on right now! Zena is telling listeners that members of the Congress are reporting they are so overwhelmed by public email, they can't manage it all. Good work people! However, as Zena pointed out: this means we need to organize ourselves into groups that our representatives can effectively respond to!



Zena is with National Forum on Judicial Accountability (NFOJA), and she's working on uniting people using NFOJA's Citizen Forums on Judicial Accountability. Get on board, and share the website with others.

Dog and pony show!

Here's a link to Full Disclosure's latest on Attorney Richard Fine. Senators and assembly members met on December 8th, in West Los Angelos California. The meeting, described by one judicial reform activist as "a dog and pony show," was supposed to be about government reform.

I posted information about SBX2 11 under the biography of Ronald George at Judgepedia. I included a link to the docket in U.S. Supreme Court, which shows the U.S. Supreme Court denied Attorney Fine a review. P.S. The website for JAIL 4 Judges is still down (I'd posted a link to it at Ronald George's biography); the group is still active and working on getting the site up again.


We need people in every state to work on judicial reform, so find others in your community who want change, and start meeting with them. 

Maine businesses are fed up with Maine government!

From a December 15 story: 

"The Kennebec Journal in Augusta quotes David Clough of the National Federation of Independent Businesses as saying that many business owners are afraid to speak out, especially those who are having trouble with a regulatory agency."

I'm guessing that the Maine Department of Labor is one of those regulatory agencies Maine businesses want "regulatory streamlining" of. 

I'm going to try to contact Clough at NFIB. I found his contact information in a story on TABOR (Taxpayer Bill of Rights). Though 79 percent of businesses support TABOR, it was defeated by taxpayers this past fall at the polls.

Maybe I'll contact the U.S. Department of Labor also. When the state of Maine refused to comply with Federal Labor Standard Law of 1938, jipping sixty-six probation officers of their overtime pay, the U.S. Supreme Court ruled that they couldn't sue the state. Here's information about Alden v. Maine in 1999.  And at the Oyez Project you can listen to arguments in the U.S. Supreme Court case, ALden v. Maine!

Writ of Habeas what? Habeas Corpus - I have the body

I sent prisoner Carol Murphy's writ of habeas corpus to U.S. District Court of Bangor Maine today. I included a September 26, 2007 newspaper article about another victim of Animal Welfare Director Norma Worley - Joan Sullivan. Sullivan's lawyer filed a motion for contempt after the state wouldn't return her horses (one died while in state custody) after a judge ordered them returned. At the webpage, http://archive.stateline.org/html/2007/09/26/80.html you'll see the story was once linked there: "Motion aims for state to return horses" about halfway down. I sent a photocopy of the newspaper clipping with Carol's writ.

In my Letter of Support I included references to other injustices, some which I've mentioned in past blogs, and I've asked to have the issue of judicial immunity addressed. One of the things I sent was a 2 pg story "Fire Maine Kennel Czar" by John Yates regarding Norma Worley. Yates passed away this fall.      

Hearing on recusals of judges set for Dec. 10, 2009!

A hearing has been set in Washington D.C. at the Rayburn House Office Building for this Thursday, December 10, 2009, regarding recusal of judges since Caperton. 

According to a story about it at the BLT (Blog of Legal Times) on the 4th: "No witnesses have been announced for the hearing." Here's a link to the schedule .

And here's a list of the members of the Courts and Competition Policy subcommittee. Please call the subcommittee members regarding Attorney Richard Fine. Judge David Yaffe should have recused himself from the case Fine was on, and his failure to do so, and imprisonment of Attorney Fine is atrocious. The "conflict of interest" was clear, for Yaffe had accepted compensation from the County of Los Angeles, which was a defendant in the case Yaffe ruled on.   

Jury selection postponed due to fall! Maine woman suing the governor!

Margot was in court to choose a jury in the state's case against her when she fell and everything was put on hold. She had to have stitches; well, she tells me she opted for the glue actually.

Margot's animals were taken from her a few years ago; and she's trying to get a trial regarding this. In a story, taken at  the webpage of the Bangor Humane Society, a reporter mentions that the state requested that Margo pay $100,000 for the care of her animals while the appeal was pending; that amount got reduced to $10,000, and then $2500, which she paid in protest. If she lost her appeal, the money would be forfeited to the state of Maine's Animal Welfare Department.


In Supreme Court, she said that their matted fur was the equivalent of dreadlocks in humans. That's funny, but what our government is doing to us isn't.
